More Information

Council has received a number of complaints from Customers that some Food Businesses, including bars are allowing dogs within their premises.

In Australia, dogs or any other animals are not permitted within food premises and this requirement is the responsibility of the business, which needs to be managed by the Proprietor of the business or the Manager in charge.

The exceptions to this rule are :

- If the animal is an assistance animal as defined by the Disability Discrimination Act 1992, then the animal is allowed within a food premises where Customers are allowed.

- Live seafood or shellfish being handled onsite.

- Certain outdoor areas can allow dogs if the business wishes to do so. These outdoor areas must :

·       Not be enclosed ( have an area without a ceiling or roof and walls and/or windows )

·       Have no food/drinks being prepared in the space

·       The area can only be entered by the public without passing through an enclosed area.

·       Can be utilised for both dining and drinking

Business Owners also need to consider other risk factors such as dogs fighting or biting Customers while onsite.

If you require professional advice to ensure your business complies, please contact Council’s Environmental Health Section on 9688 0200 or foodhealth@maribyrnong.vic.gov.au
